1. GENERAL PROVISIONS
The general conditions and instructions published here are an integral part of the contract between TIPS and TRIPS tourist agency d.o.o. that is, the authorized agency and the passenger who contracts the selected trip, excursion, arrangement or some other service offered within the scope of the travel agency's activities. If a specific provision different from those published in the points of these General Terms and Conditions is published in a particular program/offer, the provision/condition published in the program/offer shall apply. Also, the General Terms and Conditions determine the procedure for booking, paying, using the service and complaining about the services offered in the branches of TIPS and TRIPS tourist agency d.o.o., as well as in the web shop at the address www.tips-and-trips.hr and the associated subdomains / pages of projects organized by TIPS and TRIPS travel agencies.
The TIPS and TRIPS travel agency is the Seller, and the Customer is every visitor who books at least one service from the Seller at the branches of the TIPS and TRIPS travel agency, via e-mail or online store. The Customer is responsible for the accuracy and completeness of the data entered when booking and/or purchasing services. The seller cannot be held responsible for damage caused by incomplete or incorrect data provided by the buyer. In accordance with the Law on Consumer Protection, we would like to draw your attention to the fact that minors and persons who are completely incapable of doing business cannot make purchases remotely, and only their legal representatives can do so. Persons with partial business capacity can enter into an Agreement only with the consent of their legal representative.
2. CONTENT OF THE ARRANGEMENT
Travel organizer TIPS AND TRIPS tourist agency d.o.o. guarantees the implementation of the program according to the description of the arrangement in each published program. The content of the arrangement will be realized by the organizer in full and in the manner described, except in case of exceptional circumstances (war, riots, strikes, terrorist actions, sanitary disturbances, natural disasters, intervention of competent authorities, delay of aircraft and other means of transport, etc.). The travel organizer reserves the right to make minor changes to the program (order of performance/hours within defined program dates, optional services, etc.) in order to better organize the program for the benefit of the customer.
3. ARRANGEMENT PRICES
The prices of the arrangements are published in the official currency of the Republic of Croatia - euros (€) and contain the legal calculation rate of VAT for each program, and are valid from the day the program is published. The prices of services in other currencies are calculated according to the average exchange rate of the Croatian National Bank valid on the day the program is published. The organizer reserves the right to change the published prices in case of changes in the prices of accommodation, transport and other services. In accordance with the legal and contractual provisions, the buyer's consent is not required for an increase in the price of the arrangement in the amount of up to 8% of the base price of the TIPS and TRIPS arrangement (the increase is calculated on each part of the paid arrangement). In the event of an increase in the price of the arrangement in an amount greater than 8% of the basic price of the arrangement, the customer has the right to: either accept contractual changes; or accept a substitute arrangement offered by the organizer; or terminate the Agreement without the obligation to compensate for damages. The TIPS and TRIPS travel agency will notify the customer of possible changes to the prices defined in the Agreement, with the corresponding explanation, and in accordance with legal provisions, immediately upon receipt of relevant information that affects the agreed prices, no later than 20 days before the start of the trip.
TIPS AND TRIPS travel agency can provide in the program that the traveler pays for certain services at the destination. All complaints about the aforementioned services must be submitted at the destination, to the service provider. Informative prices for services abroad (optional services, tickets, taxes, etc.) can be expressed in other national or international currencies. The listed prices are for informational purposes only and are subject to exchange rate changes. If it is possible to make a pre-reservation / payment for any of the above services at TIPS AND TRIPS tourist agency branches, payment is made in the official currency of the Republic of Croatia - euros (€), calculated on the day of payment according to the middle exchange rate of the Croatian National Bank.
4. APPLICATIONS AND CONCLUSION OF CONTRACTS
Data required for booking, conclusion of contract and subsequent realization of contractual obligations and services is provided by the customer voluntarily, and TIPS AND TRIPS travel agency undertakes to act responsibly and in accordance with all applicable legal provisions and regulations. The application is made by filling out the application form, during which the customer confirms that he is familiar with and agrees with the General Terms and Conditions. Online application forms are available to the customer on the official website of the TIPS AND TRIPS travel agency and on the websites of individual projects organized by the TIPS AND TRIPS travel agency ("I have read and accept the terms and conditions in full"). Based on the information provided in the application form, the TIPS AND TRIPS tourist agency delivers the Offer to the customer. The buyer confirms acceptance of the Offer by paying an advance payment (or the full amount), and thus everything stated in the General Terms and Conditions and the program becomes a legal obligation for both the buyer/passenger and the travel organizer. After the payment has been made, the TIPS AND TRIPS travel agency delivers the travel contract to the customer. The general conditions are available in digital form on the official website of the TIPS AND TRIPS travel agency, and are attached as an integral part of the Travel Agreement. Along with the application, the customer is obliged to provide all the necessary information, submit the documents required by the program and pay an advance payment. If the customer does not provide correct information, he is responsible for all costs and consequences caused by providing incorrect information. The person who made the reservation and/or payment on behalf of several passengers confirms that he is authorized to represent all passengers named in the reservation form / application form and undertakes to forward all important information about the contracted services to all passengers, as well as to acquaint them with the relevant General Terms and Conditions. In accordance with the European General Data Protection Regulation - GDPR, TIPS AND TRIPS, the travel agency will ask travelers for only necessary and relevant data/information for making a reservation and providing services in accordance with the Agreement. In the case of contracting specific services (e.g. insurance policies, air transport, boat transport / cruises, etc.), the TIPS AND TRIPS travel agency has the right to request additional data/information from the traveler (e.g. OIB, ID card or passport number with expiration date , etc.), which should be forwarded to contractual partners (eg insurance company, airline, shipping company) for contracting and execution of the requested service. If the traveler refuses to provide the agency with the requested information, the agency cannot be held responsible for the incurred costs and consequences, i.e. the impossibility of contracting and/or performing the aforementioned services. In cases where the TIPS AND TRIPS travel agency is an intermediary and not a direct provider of the service, and when it is necessary to pass certain passenger data to the provider for the conclusion of the contract and the performance of the services, the contractual partner / provider undertakes to act in accordance with the European General Data Protection Regulation - GDPR with the data within the framework of contractual and legal obligations and undertakes to use the data exclusively for the purpose for which the customer has consent - conclusion of the contract and execution of contractual obligations and services. Unless otherwise stated in the program, Offer and Contract, the advance payment is 30% of the price of the arrangement, and the remaining 70% of the amount of the arrangement must be paid no later than 30 days before the initial date of execution of the service or program. For programs that have defined repayments in installments, the customer is obliged to respect the defined deadlines for payment of individual installments. Non-compliance with payment terms is considered a breach of contractual obligations on the part of the buyer, and the seller reserves the right to terminate the contract. The travel organizer will deliver to the travel contractor the final notification about the trip (detailed information about the departure, other relevant information about the trip and destination, vouchers if they are necessary for the trip, etc.) within a reasonable time before the start of the individual arrangement, and no later than 1 (one) day before of the start of the trip for trips lasting from 1 to 2 days and no later than 2 (two) days before the start of the trip for trips lasting longer than 2 days, to the e-mail address indicated by the Contractor on the application. TIPS AND TRIPS travel agency cannot be held responsible if the Contractor provided the agency with an incorrect e-mail address, did not check the e-mail (including promotions and spam if the notification is not in the inbox) or did not read the information provided. If the traveler has not received the Final Notice before the trip, he is obliged to inform the agency about the same, so that the Final Notice can be forwarded to a valid e-mail address or, in agreement with the agency's representatives, delivered by some other means. Agency employees are available to clients for all inquiries and information.
5. AMENDMENTS AND TRANSFER OF CONTRACT
Unless otherwise specified in the program and if the Organizer is able to fulfill the customer's request for subsequent changes to the confirmed/contracted arrangement/service, a fee for changing the reservation in the amount of €30.00 is calculated for each change to the confirmed reservation. The above fee does not include the difference in the price of the originally contracted services and the changed services, which the customer is also obliged to pay in accordance with the submitted change request and valid price lists. The transfer of the contract to another service user is possible at the customer's request only with the consent of all contracted service providers (taking into account the specific terms and conditions of individual service providers), with payment of fees prescribed by individual service providers. The transfer of festival tickets to other persons is possible only if the festival organizer allows this in the Conditions, with a prescribed fee. The transfer of tickets for sports events, taking into account specific regulations and conditions for purchase, is possible only with the consent of the organizer and in accordance with specific regulations (Law on the Prevention of Disorders at Sports Competitions). It is not possible to transfer contracted insurance policies to another person.
6. PAYMENTS
Advance payments, installments or the full amount of the arrangement can be made: via internet banking / general payment to the agency's account or via the online payment link / online store (cash and debit and credit cards: Maestro, MasterCard, Visa and Diners). Online payment is made through the CorvusPay system. Unless otherwise stated in the program, the advance payment is 30% of the price of the arrangement, and the remaining 70% of the arrangement amount must be paid no later than 30 days before the initial date of the service or program. For programs that have defined repayments in installments, the customer is obliged to respect the defined deadlines for payment of individual installments. If the customer does not comply with the defined payment terms / does not make the payment within the stipulated time, the TIPS AND TRIPS travel agency considers the arrangement canceled and adheres to the conditions for canceling the trip, which are defined in point 12 of these General Terms and Conditions. At the request of the representative of the TIPS AND TRIPS travel agency, the passenger is obliged to present a document/certificate about the paid arrangement when leaving for the trip, otherwise the passenger has no right to start the trip. Online payment: Payment in the online store www.tips-and-trips.hr (and related sub-domains / pages of projects organized by the TIPS AND TRIPS travel agency) is possible with the following cards: Express, Maestro, MasterCard, Visa, Diners and Discover. When choosing to pay by card, you will be redirected to a security-protected page, where you need to enter the required personal and card information. Your card data are not available at any time to TIPS AND TRIPS turisticka agency d.o.o. The entry and transfer of personal data and credit card number data is protected by the highest security standards provided by the WS PAY system for online authorization of credit cards in accordance with the requirements of cardholders and cardholder brands and the PCI DSS standard. Authorization and payment of credit cards is done using the WS PAY system for authorization and payment of cards in real time. Once the payment process has been completed, a confirmation of payment will be sent to the e-mail address of the reservation holder. Since these are systemically issued certificates, we ask clients who do not find a certificate in their inbox to pay attention to the promotion folder and the spam folder. Employees of the agency are available to clients for any additional inquiries related to payment deadlines, as well as for checking the success of the completed transaction / received payment. Terms of repayment by debit/credit card: Payment by card in the TIPS AND TRIPS web shop of the travel agency can be made once.

Statement on the security of online card payments via WS PAY: When paying on our web store, use WS PAY - an advanced system for securely accepting payment cards via the Internet. The WS PAY system ensures complete confidentiality of your card and personal data from the moment you enter them in the WS PAY payment form. Payment data is transmitted encrypted from your web browser to the bank that issued your card. Our store never comes into contact with complete information about your payment card. Also, the data is inaccessible even to employees of the WS PAY system. An isolated core independently transfers and manages sensitive data, keeping it completely secure. The form for entering payment data is secured with an SSL transport code of the highest reliability. All stored data is additionally protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. WS PAY meets all the requirements related to the security of online payments prescribed by the leading card brands, that is, it operates in accordance with the norm - PCI DSS Level 1 - the highest security standard of the payment card industry. When paying with cards included in the 3-D Secure program, in addition to the validity of the card itself, your bank also confirms your identity using a token or password. WS PAY considers all collected information confidential and treats it accordingly. The information is used exclusively for the purposes for which it is intended. Your sensitive data is completely safe, and its privacy is guaranteed by the most modern protection mechanisms. Only data necessary for the performance of work are collected in accordance with the prescribed demanding procedures for online payment. The security controls and operational procedures applied to our infrastructure ensure the immediate reliability of the WS PAY system. In addition, by maintaining strict access control, regular security monitoring and in-depth checks to prevent network vulnerabilities, and planned implementation of provisions on information security, they permanently maintain and improve the level of system security by protecting your card data.
7. ORGANIZER'S OBLIGATIONS
The organizer is obliged to take care of the implementation of services as well as the selection of service providers with the attention of a good organizer and to take care of the rights and interests of travelers in accordance with good customs in tourism. The organizer is obliged to provide the traveler with all the services specified in the program for a particular arrangement and is responsible to the traveler for any non-performance of services or part of the services. The travel organizer reserves the right to make minor changes to the program (order of performance/hours within defined program dates, optional services, etc.) in order to better organize the program for the benefit of the customer.
8. THE ORGANIZER'S RIGHT TO CANCEL OR CHANGE THE PROGRAM
On the basis of valid legal regulations, the Organizer can terminate the Travel Agreement and return the paid amount of the arrangement to the passenger in full, without the obligation to compensate the passenger for additional damages, if the required number of passengers is not registered for the trip. In the event of a possible cancellation due to an insufficient number of registered passengers, in accordance with applicable legal regulations, the Organizer is obliged to inform the passenger no later than:
• 20 days before the start of the trip for trips that last more than 6 days
• 7 days before the start of the trip for trips lasting between 2 and 6 days
Unless otherwise stated in the program, the minimum required number of passengers for individual trips is as follows:
• for traveling by bus: at least 40 passengers • for travel on scheduled airlines in Europe: at least 20 passengers
• for travel on intercontinental air lines: at least 15 passengers
• for travel on specially contracted flights: 80% occupancy of the aircraft
• for traveling by train or hydrofoil - according to the conditions in the individual program.
The TIPS AND TRIPS tourist agency reserves the right to complete or partial cancellation of the Agreement if extraordinary circumstances occur before or during the execution of the program that cannot be predicted, eliminated or avoided, and which, if they had occurred at the time of the conclusion of the contract, would, for the TIPS AND TRIPS tourist agency the agency was a justified reason not to conclude the Agreement. In case of cancellation of the trip/arrangement due to extraordinary circumstances that could not be avoided, the Organizer is obliged to inform the passenger about them without undue delay. In this case, the organizer will fully refund the amount paid for non-performed services to the passenger, without the obligation to compensate the passenger for additional damages. TIPS AND TRIPS travel agency reserves the right to change the day and time of departure for the trip due to a change in the flight schedule or the occurrence of force majeure, as well as the right to change the direction of travel due to changed circumstances (new schedule, strike, uncertain position of the country where the program is organized , terrorist or other threats of war, natural disasters or other unforeseeable reasons that TIPS AND TRIPS travel agency cannot influence), without special compensation and according to the applicable regulations in passenger traffic. TIPS AND TRIPS travel agency cannot take responsibility for any change during the execution of the program caused by any force majeure (item 2). In such a case, the passenger will be provided with services in another form, as far as the circumstances allow. If the TIPS AND TRIPS travel agency cancels the trip, the traveler has the right to a refund of the entire paid amount of the price of the arrangement, but does not have the right to cover the costs of visas, insurance, vaccinations or similar services required for a particular program. TIPS AND TRIPS travel agency is not responsible for bus, plane, ship or train delays, nor for program changes and costs caused by such delays. The above, in accordance with international conventions and legal regulations, does not exclude the responsibility of the carrier, except in cases where the delay of the line transport is caused by extraordinary circumstances that could not be avoided. In accordance with good business practices and moral principles, the TIPS AND TRIPS travel agency will provide travelers who find themselves in such a situation with the necessary assistance, which the traveler has the right to accept or refuse, taking into account possible additional costs. Since the TIPS AND TRIPS travel agency has no influence on weather conditions (significant influence on all types of traffic), the general situation in traffic (traffic jams / stoppages, traffic accidents, works, special traffic regulations...), the situation at border crossings / the manner of border control controls, as well as the regulations in force in road traffic related to passenger transportation, which determine mandatory breaks for bus drivers (recorded by a tachograph; longer journeys caused by delays and waiting automatically cause more breaks than expected), TIPS AND TRIPS travel agency cannot be considered responsible if the mentioned factors cause a longer duration of the trip than provided for in the program. If the circumstances at the destination make it impossible to accommodate the passenger in the reserved facility, the TIPS AND TRIPS travel agency will accommodate the passenger in another facility of the same or higher category than the one booked, at its own expense. If the traveler at the destination refuses alternative accommodation of the same or greater value, he cannot subsequently claim compensation for costs/damages from the agency. The TIPS AND TRIPS travel agency will immediately inform the traveler of any significant changes to the individual program. Significant changes to the program are considered to be: changes in the date of departure / return caused by extraordinary circumstances; change of means of transport; change of travel route; changes in accommodation capacity; cancellation of certain services that were an integral part of the program. The travel organizer reserves the right to make minor changes to the program (order of performance/hours within defined program dates, optional services, etc.) in order to better organize the program for the benefit of the customer.
9. OBLIGATIONS OF THE PASSENGER
The traveler is obliged to ensure that he personally, his documents and belongings meet the conditions stipulated by the border, customs, health and other regulations of his own country as well as of the country to which he is traveling, to comply with the house rules in catering and accommodation facilities and to cooperate with the representative of the organizer and service providers in good intention. In case of non-compliance with these obligations, the traveler is liable to the organizer and local authorities for the damage caused. If the traveler has specific requirements related to travel and accommodation or needs special care and nutrition due to his health condition, he is obliged to inform the agency about the same when arranging the trip. Examples of specific requests and services are: additional space in the vehicle or a bed larger than standard due to the passenger's above-average height and/or weight; request for specialized transportation or a specially equipped accommodation unit (especially important for people with disabilities); the need for frequent breaks during the trip due to the passenger's specific health condition; request for a specific diet, etc. The Agency will try to arrange special services for travelers who notify them of such specific requests when making travel arrangements, and will inform them prior to the conclusion of the contract whether their requests can be met. If the traveler decides to enter into a contract despite being informed by the agency that it is not possible to meet specific requirements, the traveler waives the right to appeal and claim compensation for failure to meet specific requirements. If the traveler fails to inform the agency about specific requirements when contracting the trip and it is subsequently determined that the agency is unable to contract and fulfill specific requirements, this cannot be a reason for mutual termination of the Contract or claim for compensation from the organizer. The traveler is obliged to inform himself about the trip and to read the information and related documents provided to him, and to act in accordance with them. Uninformed passengers (as well as the resulting consequences) caused by their own negligence and/or inattention cannot be the responsibility of the organizer and the basis for a complaint and claim for compensation. The travel organizer will deliver all relevant information to the Travel Contractor in the Final Notification prior to the trip, to the e-mail address indicated by the Contractor on the application. TIPS AND TRIPS travel agency cannot be held responsible if the Contractor provided the agency with an incorrect e-mail address, did not check the e-mail (including promotions and spam if the notification is not in the inbox) or did not read the information provided. If the traveler has not received the Final Notice before the trip, he is obliged to inform the agency about the same, so that the Final Notice can be forwarded to a valid e-mail address or, in agreement with the agency's representatives, delivered by some other means. Agency employees are available to clients for all inquiries and information.
10. IMPROPER BEHAVIOR OF PASSENGERS DURING THE TRAVEL AND DAMAGE COMPENSATION
Inappropriate behavior of passengers that disrupts the course of travel, destruction of material means of accommodation, transportation or other facilities, or leading to conflict situations will result in early departure home at the passenger's own expense, without refund of unused services. The Agency has no obligation to protect such a passenger from the imposition of disciplinary measures by the local security forces. In the event that the offender is a minor, the parent/legal guardian is obliged to travel to the destination at their own expense and take care of the minor, cooperate with the competent local authorities (in case of imposing disciplinary measures), as well as organize the minor's return home. The obligation of every passenger is to comply with the regulations valid at the destination, to comply with the house rules in all facilities, as well as to use the services provided in good faith. The travel organizer cannot be held responsible and will not bear the costs of any damage caused by the traveler/passengers during the trip. Accommodation facilities, according to usual practice, require a security deposit from guests upon check-in (depending on the facility, it can be by card or in cash - the currency depends on the accommodation destination). TIPS AND TRIPS travel agency will provide all necessary information about the security deposit to travelers in the Final Travel Notification. In case of damage caused, the accommodation facilities reserve the right to partially or fully take away the deposit from the traveler (depending on the amount of damage caused), as well as to charge additional damages in cases where the amount exceeds the amount of the deposit. The representatives of the accommodation facilities reserve the right to resolve the problem of damage collection directly with the offending passenger or to inform the local police about everything, who will make a record of the damage and file a report against the offender. In cases where it is not possible to determine the exact perpetrators (eg damage to common and public spaces, and in cases where there are no witnesses or surveillance cameras), all passengers and representatives of the agency bear joint responsibility (collective damage). Collective damages paid to service providers and public authorities at the destination will be partially shared by all passengers through retention of deposits (partly or in full, depending on the amount of damage). Since such situations, in addition to the material damage caused, also damage the reputation of the entire collective (both the agency itself and all the remaining passengers), the moral obligation of all passengers is to comply with the regulations and social norms valid at the destination and treat other people's property with care.
11. INTERRUPTION OR CHANGE OF TRAVEL BY PASSENGER
The traveler can, at his own request, interrupt the trip in progress with a written statement about interrupting the trip. Upon returning from an interrupted trip, the traveler is not entitled to reimbursement of expenses, regardless of travel cancellation risk insurance. During the trip, the passenger can change the program, that is, the contracted services, only with the prior written consent of the local (local) agent authorized by the TIPS AND TRIPS travel agency. The traveler is obliged to inform the TIPS AND TRIPS travel agency, as the responsible travel organizer, of such a change no later than 8 days after returning from the trip.
12. TRAVEL CANCELLATION BY THE PASSENGER
The traveler has the right to a verbal or written cancellation of the arrangement before the start of the trip at the point of sale where he registered the trip (that is, via the official email address: info@tips-and-trips.hr). In that case, the TIPS AND TRIPS travel agency has the right to reimbursement of expenses due to the canceled trip, and the amount of expenses is determined according to the date of the passenger's cancellation. In case of verbal cancellation, the passenger is obliged to sign the cancellation document prepared by the seller. If the passenger refuses to sign the cancellation document, it is considered that he has not canceled the trip. Cancellation costs for arrangements organized by the TIPS and TRIPS travel agency:
– 90 and more days before departure: 30% of the price of the arrangement,
- from 60 to 89 days before departure: 60% of the package price,
- from 30 to 59 days before departure: 80% of the package price,
- less than 30 days before departure or after departure: 100% of the price of the arrangement / no refund of payment by the agency.
If different conditions for trip cancellation are stated in a certain program, the cancellation conditions established in such program are applied. Note: For arrangements organized by partner agencies and other partner services, the terms of cancellation defined in the General Terms and Conditions of the partner (Responsible Organizer) apply. ALL BUYERS ARE RECOMMENDED TO PAY FOR INSURANCE AGAINST THE RISK OF (THE PASSENGER'S) TRIP CANCELLATION. Insurance can be chosen when registering for the trip or later by phone and email or directly at one of the insurance companies. In the event of a justified reason for canceling the trip (according to the Terms and Conditions of the selected insurance company), the traveler who has paid for insurance against the risk of cancellation shall claim reimbursement from the insurance company. Travelers who took out an insurance policy through TIPS AND TRIPS travel agency should ask the agency for the necessary forms for reporting damage. Insurance against the risk of (traveler's) cancellation of the trip is an integral part of the Insurance Package that TIPS AND TRIPS travel agency, in accordance with legal provisions, offers with all arrangements/trips offered by the agency.
13. CATEGORIZATION AND DESCRIPTION OF SERVICES
The offered hotels, apartments and other accommodation units are described according to the official categorization at the time of the program release. Categorization of facilities, food, comfort, services as well as other offers of accommodation facilities are under the supervision of local tourist organizations. Accommodation and service standards are different and not comparable. The organizer does not assume responsibility for any oral or written information that is not in accordance with the description of the services defined in the program.
14. ACCOMMODATION IN ROOMS, APARTMENTS AND OTHER ACCOMMODATION UNITS
If the buyer has not expressly agreed on a room, apartment or other accommodation unit with special features, he will accept any accommodation unit officially registered for rent in the respective facility, described in the catalog and price list. If possible, the organizer will try to satisfy the traveler's additional request for accommodation (comfort, orientation of the room, floor, etc.), but cannot guarantee the fulfillment of such a request. For trips under a pedagogical escort, the Organizer arranges passengers by accommodation units in agreement with the pedagogical escort in charge of supervising the passengers, in order to organize the trip itself as well as possible. In the event that the parent/legal guardian of a minor passenger insists on placement contrary to the requirements and recommendations of the pedagogical escort, the parent/legal guardian is obliged to submit a written request to the Organizer in which he assumes responsibility for all possible consequences arising from the approval of such a request. In the best interest of the passenger, and based on the recommendation of the pedagogical escort, the Organizer reserves the right to reject the request of the parent/legal guardian if it is determined that it would significantly affect the safety of the minor passenger.
15. EMPTY BEDS IN APARTMENTS, HOTEL ROOMS AND OTHER ACCOMMODATION UNITS
If the traveler makes the reservation of the arrangement with the price displayed per person in such a way that the number of people in the hotel room, apartment or other accommodation unit is less than the number of available beds (e.g. 1 person in 1/2 room, 3 people in 1/4 apartment or 4 people in 1/6 apartment), the agency reserves the right to charge for empty beds or to combine different passengers in order to fill them. In the event that the customer does not wish to join with other passengers or the agency cannot find additional passengers to fill the empty beds, the cost of the empty beds will be added to the basic price of the arrangement and evenly distributed among the passengers sharing the reserved accommodation unit, of which the passengers will be informed in a timely manner.
16. HEALTH REGULATIONS AND PROTECTION
According to the regulations of the World Health Organization, in order to travel to certain countries, the traveler must be vaccinated and obtain the appropriate document. Vaccination is mandatory even when such a regulation occurs after the conclusion of the Travel Contract and cannot be a reason for termination of the Contract if the vaccination is not against the traveler's health (in this case, the traveler submits a medical certificate).
17. SAFETY REGULATIONS
Local security authorities are responsible for issuing security recommendations and implementing security measures at destinations. In the event of an emergency, passengers are obliged to comply with all instructions received from the competent authorities. The Ministry of Foreign and European Affairs of the Republic of Croatia issues safety recommendations, advice, warnings and prohibitions related to travel abroad and the behavior of travelers at destinations. When organizing a trip, the TIPS AND TRIPS travel agency is guided by the recommendations of all official bodies responsible for risk and safety assessment. Personal assessments of travelers cannot be considered as a basis for termination of the Agreement, refund of payments or compensation of damages by the organizer. In the event that the local security authorities at the destination and/or the Ministry of Foreign and European Affairs of the Republic of Croatia issue a ban on travel to a specific destination, the trip will be canceled or postponed until the end of extraordinary circumstances that would threaten the safety of passengers. In the event of such a ban being issued by the competent authorities, the traveler has the right to terminate the Agreement with the refund of the amount paid for the arrangement, without the right to request additional compensation.
18. TRAVEL INSURANCE PACKAGE
Unless otherwise stated in the program/offer, the programs organized by the TIPS AND TRIPS travel agency do not include health insurance in case of sudden illness or accident for a stay abroad, as well as other travel insurance. When booking a TIPS AND TRIPS travel agency arrangement at an authorized point of sale, sellers will offer travelers the option of insurance during their stay abroad. Examples of insurance are: insurance against the consequences of an accident and illness during the trip, damage and loss of luggage, voluntary health insurance during the trip and stay abroad, insurance in case of trip cancellation, insurance that covers the costs of assistance and the return of the passenger to the place of departure in the event accidents and illnesses, etc. TIPS AND TRIPS tourist agency offers customers policies of the contractual partner: Euroherc osiguranje d.d. The traveler is obliged to familiarize himself with all types of insurance offered by the seller. The seller can also offer combinations of different insurances on more favorable terms than when each form of insurance is taken separately. Certain policies can only be contracted when concluding the contract / they cannot be contracted afterwards (e.g. cancellation insurance). WE ESPECIALLY RECOMMEND CHOOSING A HEALTH INSURANCE PACKAGE ABROAD TO BUYERS. Note: In accordance with the valid Insurance Act and the conditions of operation of insurance companies on the territory of the Republic of Croatia, some insurances can only be contracted for citizens of the Republic of Croatia or citizens of European Union member states. Also, specific types of insurance can be contracted only for adults or in a certain period before the start of the trip, and the offered insurance varies depending on the destination of the trip. If the agency is not able to arrange the requested insurance, the buyer will be informed about it when concluding the Agreement and this cannot later be the reason for termination of the Agreement, appeal or compensation claim.
19. PASSENGER'S LUGGAGE
Unless otherwise stated in the program and offer, the passenger has the right to free transportation of up to 15 kg of luggage on charter flights and up to 20 kg of luggage on regular airlines and in bus transportation. For each excess kilogram of luggage, the passenger pays an additional fee to the carrier. Children under the age of 2 are not entitled to free baggage transportation. The TIPS AND TRIPS travel agency cannot be held responsible if the passenger's luggage cannot be transported due to the passenger exceeding the permitted amount, weight or dimensions of the luggage. Each passenger is responsible for his luggage and other personal belongings, and the travel organizer cannot be held responsible for their loss and/or damage. Baggage is transported at the passenger's risk, so we recommend securing the luggage. The organizer is not responsible for destroyed or lost luggage, as well as for the theft of luggage or valuables in the accommodation facility (we recommend renting a safe!).
20. INSURANCE IN CASE OF BANKRUPTCY OF THE TRAVEL ORGANIZER
In accordance with the Law in case of bankruptcy of the TIPS AND TRIPS travel agency, travelers caught on trips, as well as persons who have paid advance payments for the trip, should contact the insurer specified in the Travel Contract or another appropriate document as soon as possible. document.
21. LIABILITY INSURANCE
In accordance with the Act on the provision of services in tourism, the TIPS AND TRIPS travel agency has an insurance contract concluded with the insurer for liability insurance for damage caused to the traveler by non-fulfillment, partial fulfillment or improper fulfillment of obligations related to the package arrangement.
22. GENERAL RULES
TIPS AND TRIPS travel agency allows customers to purchase gift vouchers that can be used for services from the offer with the following conditions of use: - Each gift voucher can be used for 3 months from the date of purchase, unless a different period is indicated on the gift voucher. - The gift voucher can only be used in the name of the person indicated on the gift voucher. – Gift vouchers are not transferable. - The gift voucher can be used for any travel package booked through the TIPS AND TRIPS travel agency - The gift voucher cannot be exchanged for money. - The gift voucher is calculated as a "discount" on the selected arrangement, and in case the price of the arrangement is higher than the amount of the gift voucher, the client can pay the price difference in cash or by card. - The gift voucher cannot be used for arrangements worth less than the amount of the gift voucher, since it is impossible to refund the difference in price.
23. COMPLAINT RESOLUTION
If the services from the program are performed incompletely or with poor quality, the passenger can demand proportionate compensation by submitting a written complaint. Every passenger - contract holder has the right to complain on the basis of non-performed contracted service. The organizer will not process group complaints - those submitted by several contract holders on the basis of one complaint. Complaints can be submitted within the prescribed period in person at the agency's offices, by mail to the address of the headquarters (TIPS AND TRIPS turisticka agencija d.o.o., Blaža Lorkovića 4, 10000 Zagreb, Croatia) or to the agency's official e-mail address (info@tips-and-trips. en). TIPS AND TRIPS travel agency does not accept complaints for offers and arrangements of other responsible organizers and service providers that were booked and paid through mediation through TIPS AND TRIPS travel agency. In this case, the traveler should submit a complaint directly to the organizer, in accordance with the travel conditions of the individual organizer. Complaint procedure: 1. Immediately at the event location, the traveler complains about the inappropriate service to the organizer's representative, and if there is none, to the service provider. The passenger is obliged to cooperate with the representative and/or service provider in good faith in order to eliminate the causes of the complaint. If the passenger at the venue does not accept the offered solution to the complaint that corresponds to the service paid for, the organizer will not consider the passenger's subsequent complaint or respond to it. 2. If the reason for the complaint has not been eliminated, the passenger must draw up a written confirmation of this with the representative of the organizer or the service provider. 3. No later than 8 (eight) days after returning from the trip, the traveler submits a written complaint and encloses a written confirmation signed by a representative of the organizer or service provider, as well as any invoices for additional costs. Complaints can be submitted in person at the agency's offices, by mail to the headquarters address (TIPS AND TRIPS turisticka agencija d.o.o., Blaža Lorkovića 4, 10000 Zagreb, Croatia) or to the agency's official e-mail address (info@tips-and-trips.hr). The organizer will process only fully documented complaints that have been duly submitted to the organizer within the specified period of 8 (eight) days, counted from the day the passenger returns from the trip. 4. In accordance with the legal provisions, the organizer is obliged to issue a written solution to the complaint received within 15 days after receiving the complaint at the point of sale. The organizer may postpone the deadline for the resolution of the complaint due to the collection of information and verification of the allegations made in the complaint with the service provider. In the event of the need for additional documentation or the need to extend the deadline for the delivery of the solution in order to collect relevant information and evidence, the Organizer will inform the complainant about the same. The organizer will handle only those complaints whose cause could not be eliminated at the time of their occurrence. 5. Until the Organizer makes a decision, the traveler renounces the mediation of any other person, judicial institution, as well as giving information to public media. 6. The highest compensation per complaint can reach the amount of the advertised part of the services and cannot include services already used, as well as the entire amount of the arrangement. This excludes the buyer's right to compensation for ideal damages. Public expression of dissatisfaction: In accordance with good business practice, in case of dissatisfaction, the buyer will first inform the organizer about the same, with the aim of finding an amicable solution, and will refrain from public announcements (media, social networks and other forms of public media) until a solution is reached. If the buyer decides to make public appearances, he is aware of the fact that the aforementioned may be the subject of criminal proceedings for criminal offenses against honor and reputation, in accordance with the Criminal Code - Chapter XV.
24. COMPETENT AUTHORITIES
Pursuant to point 23 of these General Terms and Conditions, the customer of the TIPS AND TRIPS program of the travel agency has the right to complain to the program organizer. Both parties undertake to try to resolve possible disputes amicably. If the buyer is not satisfied with the organizer's decision, he has the right to court arbitration. For such a case, the jurisdiction of the court in the place of business of the responsible organizer is agreed upon. The court in Zagreb is responsible for trips and programs organized by the TIPS AND TRIPS travel agency, and the regulations and laws valid in the Republic of Croatia apply. Competent body whose official supervision is subject to the activity of a travel agency in performing and providing services in tourism: Ministry of Tourism - Independent Sector of Tourist Inspection, Trg Republike Hrvatske 8/1, 10000 Zagreb, Croatia.
25. NAMES OF INDIVIDUAL PARTS
The names of individual parts of these General Terms and Conditions serve only for ease of reference and have no influence on their interpretation.
26. SALVATORY CLAUSE
If any provision of these General Terms and Conditions or any annex for specific trips and the Agreement is later found to be invalid, this will not have an effect on the other provisions, and the Agreement and these General Terms and Conditions as well as possible annexes for specific trips as a whole remain valid, with that the contracting parties will replace the void provision with a valid one that will, to the greatest extent possible, enable the achievement of the goal that was intended to be achieved by the provision that was found to be void.
SPECIAL CONDITIONS AND INSTRUCTIONS FOR TOURIST ARRANGEMENTS:
1) ACCOMMODATION TIME IN APARTMENTS, HOTELS AND OTHER ACCOMMODATION UNITS: it is different and indicated separately for each program. The usual check-in time for hotel rooms is after 2 pm, and for apartments after 4 pm. The usual time of leaving the hotel room and apartment is until 10 o'clock. The representatives of the accommodation units have the right to inspect the personal documents of the guests and to copy their personal data for the purpose of the tourist records of the guests, as well as to take a security deposit.
2) SKIING/WINTERING PROGRAM: For the cancellation of the contract on the skiing arrangement, we apply the cancellation conditions according to point 12 of the General Terms and Conditions, regardless of the reason for cancellation. Unfavorable snow conditions cannot be a reason for cancellation due to force majeure, and the TIPS AND TRIPS travel agency applies the general cancellation conditions specified in point 12 for such cancellation of the arrangement.
3) TRAVEL IN THE ORGANIZATION OF OTHER RESPONSIBLE ORGANIZERS/TOUR OPERATORS: – Intercontinental trips: all special conditions are published for each individual program, that is, the conditions of the responsible organizer specified for each trip apply. – All programs in which TIPS AND TRIPS touristic agency d.o.o. acting as an intermediary: TIPS AND TRIPS turistica agency d.o.o. is not responsible for the implementation of travel or tourist arrangements for which the organizer is not responsible, but only mediates the sale. All travel arrangements provided by TIPS AND TRIPS turistica agency d.o.o. represented as an intermediary are specially marked, which will be visible in the published program and on the travel confirmation. In this case, the traveler through TIPS AND TRIPS tourist agency d.o.o. signs a contract with the aforementioned responsible travel organizer. APPENDIX I. - Form with standard information for package travel contracts, in accordance with the Act on the provision of services in tourism NN 130/17 The offered combination of travel services is a package arrangement within the meaning of the Act on the provision of services in tourism. The traveler therefore has all the rights arising from the provisions of the Act on the provision of services in tourism, which refer to the package-arrangement. TIPS AND TRIPS tourism agency d.o.o. is fully responsible for the proper execution of the package arrangement as a whole. TIPS AND TRIPS tourism agency d.o.o. has a legally prescribed insured guarantee for compensation of the passenger's payments and, if the transport is included in the package arrangement, ensuring the repatriation of the passenger in the event that it/they become insolvent. The most important rights in accordance with the Law on providing services in tourism:
• Travelers will receive all essential information about the package deal before concluding a contract for travel in the package deal.
• There is always at least one merchant who is responsible for the proper execution of all travel services covered by the contract.
• Travelers receive an emergency phone number or contact point information through which they can get in touch with the organizer or travel agency.
• Passengers can transfer the package arrangement to another person with reasonable notice and possible payment of additional costs.
• The price of the package arrangement can be increased only if specific costs (for example, the price of fuel) increase and if this is expressly stipulated in the contract, and in any case no later than 20 days before the start of the package arrangement. If the price increase exceeds 8% of the price of the package arrangement, the passenger can terminate the contract. If the organizer reserves the right to increase the price, the passenger has the right to a price reduction if the relevant costs are reduced.
• Travelers can terminate the contract without paying any termination fee and receive a full refund of all payments if any of the essential elements of the package arrangement other than the price are significantly changed. If before the start of the package arrangement the merchant responsible for the package arrangement cancels the package arrangement, passengers have the right to a refund and, if necessary, compensation.
• Travelers may terminate the contract without paying any termination fee prior to the start of the package arrangement in case of extraordinary circumstances, for example if there are serious safety issues at the destination that could affect the package arrangement.
• In addition, travelers can terminate the contract at any time before the start of the package arrangement by paying an appropriate termination fee that can be justified.
• If, after the start of the package arrangement, significant elements of the package arrangement cannot be provided as agreed, alternative arrangements will have to be offered at no additional cost. If the services are not provided in accordance with the contract and this significantly affects the execution of the package arrangement, and the organizer does not correct the non-conformity, travelers may terminate the contract for travel in a package arrangement without paying a termination fee.
• Passengers have the right to a price reduction and/or compensation if the travel services are not performed or if they are performed improperly.
• If the traveler finds himself in difficulties, the organizer must provide him with help. Data processing includes any handling of clients' personal data from the moment of receipt. Data required for reservation, conclusion of the Agreement and subsequent implementation of contractual obligations and services are provided by the customer voluntarily. The person who made the reservation on behalf of several passengers confirms that he is authorized to represent all passengers named in the reservation form and submit their information to the agency. Only the necessary information is required from the customer for making a reservation / conclusion of the Agreement and provision / execution of services in accordance with the Agreement. In cases where TIPS AND TRIPS tourism agency d.o.o. an intermediary, not a direct provider of the service, and when for the conclusion of the Agreement and the performance of the services it is necessary to forward certain data of the passenger to the provider (e.g. data required for drawing up an insurance policy with an insurance company, data required for booking an airline or ship ticket, rooming list submitted to the accommodation unit, data about guests collected by local tourist boards in accordance with the legal provisions on residence taxes, etc.) the contractual partner / executor undertakes, in accordance with the European General Data Protection Regulation - GDPR, to handle the data within the framework of contractual and legal obligations and undertakes to use the data exclusively for the purpose for which it has the consent of the customer - conclusion of the Agreement and execution of contractual obligations and services. Competent authorities (competent inspections, police, judicial authorities) have the right to inspect client data / official documents containing client data, in accordance with legal provisions. Authorized representatives of competent authorities can, as necessary, make copies of available documents, copy all contents of the storage system and collect other relevant information. The legal basis for the transfer and processing of data for these purposes is the fulfillment of legal obligations. The standard information about clients that is collected through the reservation forms is: name and surname, address, date of birth, contact phone number / mobile phone, contact e-mail, handwritten signature (in the case when the client contracts services in person at the branch and fills out a physical application form, data about the means of payment (e.g. account number or card data in the case of filling out the form for remote authorization). In order to organize the trip as well as possible and provide the highest quality services, TIPS AND TRIPS turisticka agencia d.o.o. may ask the client for some additional information and data, and which the client provides voluntarily. In the case of school / student trips, and in order to better organize the trip itself (schedule by accommodation units, buses, etc.), information is also collected from the clients about the educational institution they are currently attending. In the case of contracting specific services, TIPS AND TRIPS touristic agency d.o.o. has the right to request additional information from the client (e.g. OIB, personal identification number identity cards or passports with an expiration date, etc.), which should be forwarded to contractual partners in order to contract and perform the requested service. In the event that the client submits data from the category of specially protected personal data (e.g. data on health), the client gives his consent to the processing of this data for the purpose of executing the Agreement - provision of special services. TIPS AND TRIPS tourism agency d.o.o. collects and processes the following client data for the purpose of communicating with clients, providing information about new offers, providing requested information as well as fulfilling legal and contractual obligations: data entered by clients in the contact form on the official website www.tips-and-trips.hr and belonging to sub-domains / pages of projects organized by TIPS AND TRIPS turisticka agency d.o.o.; data entered by clients in pre-registration and newsletter forms; data submitted by clients via electronic mail / official correspondence.When the client visits the website, cookies are collected (English - http://www.allaboutcookies.org) that enable an improved search experience based on location, language and other settings and client preferences. By blocking "cookies", the client can still browse the site, but there is a possibility that some features and contents will not be available. Also, each client has the option to delete and/or block "cookies" at any time in the settings of the internet browser they use. The main systems through which data is collected and processed, that is, the necessary documentation is created and communication with clients is carried out and marketing activities are carried out:

Ads that are displayed to the client through Google and social networks are not necessarily the result of collected data about the client and/or "cookies", since the ads are displayed even if they are deleted / blocked, but with less relevant content. Clients can find more about the policy of advertising through Google and social networks on the official pages of individual services. Trips and projects organized by TIPS AND TRIPS travel agency d.o.o., for the purpose of the company's legitimate interests and public interest, are subject to photography and recording by official photographers and videographers, as well as media representatives. These are photographs and recordings taken during public events (concert, party, group trip, etc.) on public surfaces / inside public spaces, and the same are used in media announcements as well as marketing promotions of the events and trips themselves, which does not violate the right clients on privacy protection. Taking into account the legitimate interests of clients and the legitimate interests of TIPS AND TRIPS turistica agency d.o.o., the contact information provided by clients is used for the purpose of informing clients about: payment deadlines and debts for ongoing reservations; all important information or possible changes related to offers and contracts; final notifications before the trip; discounts that the client can obtain; new offers that might be of interest to the client based on previously expressed interest. The client reserves the right to unsubscribe from the newsletter list at any time (by clicking on "Unsubscribe") and will no longer receive notifications about new offers and discounts. Likewise, the client can sign up for the newsletter again at any time / renew his consent for the use of data for marketing purposes. The client has the right from TIPS AND TRIPS tourist agency d.o.o. request information about which of his personal data is processed and stored, as well as request correction in case of incorrect data or deletion of certain data for which there is no legal basis for storage. About the solution of such request TIPS AND TRIPS turisticka agencija d.o.o. will inform the client within the legal deadline of one month at the latest. This deadline, with an explanation given to the client, can be extended by an additional two months if necessary, taking into account the complexity and number of requests. TIPS AND TRIPS tourism agency d.o.o. cannot comply with the client's request for the deletion of data and/or documents necessary for the performance of contractual services, as well as data and/or documents that the agency, in accordance with legal provisions, must keep until the expiration of the legal retention periods (e.g. offers, contracts, invoices, etc.) . The client can exercise his rights by submitting a request: by e-mail to info@tips-and-trips.hr or by written request sent to the address of the headquarters - TIPS AND TRIPS turisticka agencija d.o.o., Blaža Lorkovića 4, 10000 Zagreb, Croatia. All reasonable requests of TIPS AND TRIPS turisticka agency d.o.o. clients. will comply without charge and without undue delay. Pursuant to Article 12, point 5 of the General Data Protection Regulation, if the client's requests are clearly unfounded or excessive, especially due to their frequent repetition, TIPS AND TRIPS tourist agency d.o.o. will exercise its legal right to charge a reasonable fee for the administrative costs of providing the information or refuse to act on the request. Pursuant to Article 14, the obligation to provide information does not need to be imposed if the client already possesses that information (he is already aware of the information he has submitted), if the recording of personal data is prescribed by law (e.g. tourist records) and if providing the information to the client is impossible or would required a disproportionate effort.
